2. USE OF MMT SERVICES & BOOKING AUTHORITY
You warrant that you are at least 18 years of age and possess the legal authority to enter into this Agreement and to make travel bookings with MMT. You agree to be financially responsible for all travel bookings you make with us, whether made on behalf of yourself or for other members of your traveling party. You warrant that all information supplied by you on behalf of yourself, members of your household, or others for whom you are authorized to transact business with us is true and accurate. You agree that you will only make legitimate reservations or purchases with MMT and its Suppliers; any speculative, false, or fraudulent reservation is strictly prohibited.
Separate Supplier terms and conditions will apply to your reservation and purchase of travel-related goods and services. You understand and agree that by booking travel through MMT, you are also agreeing to the booking terms of each Supplier partner selected for your itinerary.
3. TRAVEL DOCUMENTATION & TSA/DHS COMPLIANCE
- Verification of Accuracy: The name, date of birth, and gender that appears on your identification card must exactly match the data listed on your tickets and booking records. Any discrepancy may result in denied boarding or undue delay at security checkpoints.
- The 24-Hour Review Rule: WHEN YOU RECEIVE YOUR TRAVEL DOCUMENTS, IT IS YOUR RESPONSIBILITY TO REVIEW AND VERIFY ALL INFORMATION. Contact MMT immediately if changes are required. If you have not notified us of necessary corrections within twenty-four (24) hours of receiving your documents, MMT bears no responsibility for any additional costs associated with making necessary corrections.
- Identification Requirements: It is the responsibility of each Client to obtain and carry a valid passport book, visa(s), and all other documents required by applicable government regulations. Passport cards are not accepted for most international travel. Certain countries will not admit a passenger if their passport expires within six (6) months of the anticipated date of return.
- Minors: Children and infants may also require travel documents. Minors traveling without both parents may require authenticated consent forms. Refer to https://help.cbp.gov for group travel requirements for children under 19.
4. AIR TRAVEL, SCHEDULES, & CHECK-IN
Your airline ticket is a contract between you and the air carrier, even if purchased through MMT.
- Check-In: Due to enhanced security, it is strongly recommended that you check in at least 2 hours prior for domestic flights and 3 hours for international flights.
- Reconfirmation: You must reconfirm flight times at least 24 hours prior to domestic departures and 72 hours for international departures. MMT shall not assume responsibility for air schedule changes, baggage fees, seat assignments, or the failure of an airline to deliver services.
- Independent Air: MMT is not responsible for losses resulting from changes in air reservations made independently of MMT. We cannot assist with schedule changes or delays for air arrangements not booked through our agency.
- Loyalty Points: Hotel and airline rewards or points generally cannot be redeemed for travel arrangements made by MMT, and MMT has no liability if the accrual of miles or points is denied.
5. PAYMENTS, CANCELLATIONS, & POST-PURCHASE PRICE INCREASES
- Financial Responsibility: You are responsible for all charges, fees, duties, and taxes arising out of your travel bookings. By submitting a credit card authorization, you agree to allow MMT to use your payment method to purchase travel products from Suppliers on your behalf.
- Price Increases: Pursuant to U.S. Department of Transportation (DOT) regulations, we reserve the right to correct pricing errors. Federal law prohibits “post-purchase price increases” except for those resulting from increased government-imposed taxes or fees. By signing this agreement, you expressly acknowledge and provide your written consent to any such post-purchase price increases and authorize MMT to charge your payment method for such costs.
- Cancellation Penalties: All cancellation requests must be sent to MMT in writing. Third-party Supplier cancellation penalties will apply. In some cases, there is NO REFUND once a booking is made and under deposit.
- Unused Portions: When tour, cruise, or package prices are based on Suppliers’ contract rates, you will not be entitled to any refund for any unused portion of travel, including hotel nights, meals, or excursions.
6. STRICTURE ON CHARGEBACKS & PAYMENT DISPUTES
EXCEPTING IN CASES OF FRAUD, YOU AGREE NOT TO FILE ANY DISPUTE WITH YOUR BANK OR CREDIT CARD COMPANY TO AVOID OR VIOLATE ANY BOOKING TERMS AND CONDITIONS OF MMT OR ITS SUPPLIERS.
This includes cancellations or changes of itinerary for reasons beyond the control of MMT or its Suppliers. If you attempt to chargeback, reverse, or recollect a previously authorized trip payment, MMT reserves the right to collect all additional costs, fees, and expenses associated with such actions, including, without limitation, reasonable attorney fees.
7. HEALTH, SAFETY, & LEGAL ENTRY REQUIREMENTS
- Immunizations: You must have proper immunizations and health screenings before travel. Check https://travel.state.gov and http://wwwnc.cdc.gov/travel/ for relevant health issues.
- Criminal History: Each country holds different views of past criminal offenses (e.g., DWI or unpaid child support may restrict entry to Canada). MMT does not inquire about criminal records; it is your responsibility to verify entry requirements.
8. FORCE MAJEURE & UNFORESEEN CIRCUMSTANCES
MMT will not be in breach of these terms or otherwise liable for any failure or delay due to causes beyond its reasonable control, including: acts of God, accident, riots, war, terrorist act, epidemic, pandemic, quarantine, breakdown of communication facilities, natural catastrophes (floods, extreme weather, volcanic eruptions), governmental acts, or national strikes. In such events, Suppliers may, in their sole discretion, vary, postpone, or cancel any itinerary. Payment of any refund remains in the sole discretion of the Supplier.
9. LIMITATIONS OF LIABILITY & CLIENT CONDUCT
- Supplier Liability: MMT is not liable for any personal injury or property damage arising out of Supplier services. MMT disclaims any liability whether based on contract, tort, or strict liability, including without limitation liability for any direct, punitive, or consequential damages in connection with goods or services provided by any principal Supplier.
- Itinerary Alterations: The Supplier may determine that alterations in itinerary are necessary for reasons including severe weather. MMT bears no responsibility for such changes.
- Recovery Limit: MMT HAS SOLELY RECEIVED COMMISSION AND FEES FOR TRAVEL TRANSACTIONS. CLIENT AGREES THAT ANY RECOVERY FROM MMT WILL BE LIMITED TO THE AMOUNT OF COMMISSION AND FEES ACTUALLY RECEIVED BY MMT.
- Conduct: You accept responsibility for any damage or loss caused by you. Any transportation, possession, or use of illegal drugs will result in immediate termination of your trip and may result in prosecution.
10. TRAVEL INSURANCE DISCLOSURE
MMT OFFERS ACCESS TO TRAVEL INSURANCE TO PROTECT PASSENGERS AND THEIR INVESTMENT. Unless specifically noted, travel insurance is not included in the cost of your itinerary. Proper insurance may protect against supplier default, delay, interruption, medical emergency, and cancellation. If you decline insurance, you understand that Supplier cancellation penalties will apply resulting in the loss of monies up to the full cost of your booking. MMT advisors are not licensed insurance brokers and are not authorized to evaluate the adequacy of your existing insurance coverage.
11. DISPUTE RESOLUTION, JURISDICTION, & GOVERNING LAW
The laws of the State of Georgia govern these Terms and Conditions. These Terms are intended to be consistent with the Georgia Fair Business Practices Act. You hereby consent to the exclusive jurisdiction and venue of courts in Cherokee County, Georgia in all disputes arising out of or relating to travel bookings with MMT. Any claim against MMT must be brought within 12 months after the date of the completion of the trip. You waive any right to claim punitive or exemplary damages and agree that you may only bring claims in your individual capacity and not as plaintiffs or class members in any class action.
12. ENTIRE AGREEMENT & RESERVATION OF RIGHTS
These Terms constitute the entire agreement between the Client and MMT. We reserve the right, in our sole discretion, to change these Terms and Conditions at any time. Updated versions will be posted on our website and are effective immediately. A printed version of this agreement shall be admissible in judicial or administrative proceedings based upon or relating to these Terms to the same extent as other business documents and records.
